Finally, on January 13, 2002, Damrah was arrested and charged with the illegitimate procurement of US citizenship. Like the original al-Arian investigation, Damrah's charges dealt with his deliberate failure to include pertinent information and including false statements on his application for naturalization in 1993.121 Among the crucial information that Damrah failed to disclose was his undeniable involvement with the Al Kifah Refugee Center and his association with PIJ and ICP.122 The violations continued with Damrah falsely stating on his application that he had never incited or supported the persecution of any individual on the basis of inherent characteristics such as race or religion,123 which, based on his inflammatory comments during ICP events, was demonstrably false.

Damrah was eventually found guilty by a jury, spent two months in prison, and was released in January 2005.124 As part of the sentence subsequent to his release, Damrah was required to comply with a fourmonth period of house arrest.125 On March 15, 2005, the US Court of Appeals for the Sixth Circuit upheld his conviction,126 clearing the way for deportation hearings to begin. In January 2006, three years after Damrah's initial arrest, he reached an agreement with the government to be deported to either Qatar, United Arab Emirates, Sudan, Egypt, or the Palestinian territories. 127
